1. Introduction
These Terms of Use (“Terms”) govern your access to and use of the Firmament Trackers software and services, including our Android App and website SaaS product (collectively, the “Services”), provided by Journal of Geocentric Cosmology LLC (“we,” “us,” or “our”). By signing up for an account, accessing, or using the Services, you agree to be bound by these Terms.

2. Acceptance of Terms
To use the Services, you must accept these Terms by checking the box indicating your acceptance when you sign up for an account through Stripe. If you do not accept these Terms, you will not be able to access or use the Services.

3. Intellectual Property Rights
The Services, including all software, source code, business logic, and intellectual property rights, are owned by Firmament Trackers and are protected by applicable copyright, trademark, and other intellectual property laws. You acknowledge that you have no right, title, or interest in or to the Services, except for the limited right to use the Services in accordance with these Terms.

4. Restrictions on Use
You agree not to:

  • Decompile, disassemble, or reverse engineer the Services or any software or source code provided by Firmament Trackers;
  • Leak or disclose any source code, business logic, or confidential information related to the Services;
  • Use the Services for any purpose that is prohibited by these Terms or applicable law;
  • Interfere with or disrupt the Services or any servers or networks connected to the Services;
  • Use the Services to infringe on the intellectual property rights of any third party.

5. Account Security
You are responsible for maintaining the security of your account and for all activities that occur under your account. We recommend using Facebook or Gmail login to access the Services, which eliminates the need for passwords. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

6. Payment Terms
To access the Services, you must purchase a license or subscription through one of our authorized payment processors.

When you sign up for an account and purchase a subscription through Stripe, you will be required to accept these Terms as part of the checkout process. By checking the box indicating your acceptance, you acknowledge that you have read, understand, and agree to be bound by these Terms.

When you purchase a license through Google Play Store, you agree to these Terms and to the Google Play Store terms of service. By completing the purchase, you acknowledge that you have read, understand, and agree to be bound by these Terms, and you authorize Google to charge your designated account.

When you purchase a license through Apple App Store, you agree to these Terms and to the Apple App Store terms and conditions. By completing the purchase, you acknowledge that you have read, understand, and agree to be bound by these Terms, and you authorize Apple to charge your designated payment method.

By completing any subscription purchase, you agree to pay the applicable fees and to abide by the terms of the purchase agreement.

7. Academic SaaS Subscription
The Academic SaaS subscription is available at $20 per year and provides access to advanced features designed for academic and research purposes. By purchasing this subscription:

  • You acknowledge that the subscription fee is non-refundable once the welcome email has been sent and internal URLs have been exposed;
  • Access to the subscription features begins immediately upon receipt of the welcome email;
  • The subscription will automatically renew annually unless cancelled before the renewal date;
  • Internal URLs and access credentials provided are for your exclusive use and may not be shared with third parties.

8. Scientific Claims and Usage Guidelines
The Firmament Trackers application is designed as a research tool for scientific purposes. Users should be aware that:

  • The application’s outputs and data interpretations are intended for research and academic study;
  • Unless supervised by an individual with appropriate educational background and expertise to properly interpret the application’s outputs, users should consider the application’s results as being for entertainment purposes only;
  • The scientific methodologies and algorithms employed by the application are based on specific theoretical frameworks and may not represent consensus views in all scientific communities;
  • Users are encouraged to maintain a critical and analytical approach when interpreting results;
  • The application should not be used as the sole basis for making scientific conclusions without proper peer review and validation.

9. Refund Policy
All sales are final, and refunds will not be issued except in accordance with our refund policy, which is available on our website.

10. Termination
We reserve the right to terminate or suspend your access to the Services at any time, without notice, if we believe that you have breached these Terms or if we decide to discontinue the Services.

11. Disclaimer of Warranties
The Services are provided “as is” and “as available,” without warranty of any kind, express or implied. We do not guarantee that the Services will be uninterrupted, secure, or error-free.

12. Limitation of Liability
In no event will we be liable for any damages, including consequential, indirect, special, or punitive damages, arising out of or related to the use of the Services.

13. Governing Law
These Terms will be governed by and construed in accordance with the laws of the State of Wyoming, without giving effect to any principles of conflicts of law.

14. Changes to Terms
We reserve the right to modify or update these Terms at any time, without notice. Your continued use of the Services after the effective date of any changes will constitute your acceptance of the updated Terms.

By accepting these Terms, you acknowledge that you have read, understand, and agree to be bound by them.

Stripe Checkout Terms

When you sign up for an account and purchase a subscription through Stripe, you will be required to accept these Terms as part of the checkout process. By checking the box indicating your acceptance, you acknowledge that you have read, understand, and agree to be bound by these Terms.
